RentalFlexi ("we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, and safeguard your data when you visit rentalflexi.co.za or use our mobile applications (collectively, the "Platform").

1. Information We Collect

To operate the peer-to-peer marketplace effectively, we collect several categories of personal information:

Account Data: Full name, email address, physical address, phone number, and profile picture.
Identity Verification (POPIA Requirements): South African Identity Document (ID) or passport numbers, driver’s licence details, and real-time facial photographs (selfies) for biometric verification.
Vehicle Information: For Hosts, we collect vehicle registration numbers, licence disc details, vehicle identification numbers (VIN), maintenance history, and photographs of the vehicle.
Financial Details: Credit card, debit card, or banking details processed via secure, PCI-DSS compliant South African payment gateways (e.g., PayFast, Peach Payments). We do not store raw card numbers on our servers.
Telematics and Location Data: Real-time GPS location of vehicles during active trips via integrated tracking devices to ensure vehicle security and manage mileage tracking.

2. How We Use Your Information

We process your personal information under lawful grounds as prescribed by POPIA:

Service Delivery: Verifying user profiles, processing bookings, and facilitating secure communication between Hosts and Guests.
Risk and Fraud Management: Performing background checks, validating driver’s licences, assessing creditworthiness, and preventing fraudulent accounts.
Safety and Security: Monitoring vehicle locations using telematics to prevent vehicle theft, unauthorized cross-border travel, or recovery in the event of an accident.
Legal Compliance: Complying with South African law enforcement requests, processing traffic fines (AARTO/e-tolls), and managing insurance claims.

3. Information Sharing and Disclosure

We do not sell your personal information. We only share data under the following circumstances:

Between Hosts and Guests: Once a booking is confirmed, we share limited contact info (first name, phone number) and vehicle location details to facilitate vehicle handovers.
Third-Party Service Providers: We share data with verified identity verification partners, credit bureaus, insurance underwriters, and tracking/recovery companies operating in South Africa.
Legal and Regulatory Bodies: We disclose information to the South African Police Service (SAPS), traffic authorities, or courts when legally compelled to do so.

4. Cross-Border Data Transfers

RentalFlexi may occasionally utilize secure cloud hosting services (such as AWS or Microsoft Azure) located outside the borders of the Republic of South Africa. In accordance with Section 72 of POPIA, we ensure that any international data handlers are bound by strict data privacy agreements that match or exceed South African privacy protections.

5. Security of Your Information

We implement robust technical and organizational security measures to protect your data against unauthorized access, loss, or alteration. These include end-to-end data encryption (SSL/TLS), firewalls, and strict internal access controls. While we take every reasonable precaution, no online platform can guarantee 100% security.

6. Your POPIA Rights

As a South African data subject, you hold specific rights regarding your personal information:

Right to Access: You can request a copy of the personal information we hold about you at any time.
Right to Correction: You can demand the correction or updating of inaccurate, outdated, or incomplete personal data.
Right to Deletion: You can request that we delete your personal information, subject to statutory data retention laws (e.g., financial records must be kept for tax purposes under SARS regulations).
Right to Object: You can object to the processing of your data for direct marketing purposes.
