RENTALFLEXI TERMS OF SERVICE

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. BY ACCESSING THE RENTALFLEXI PLATFORM, YOU AGREE TO COMPLY WITH AND BE BOUND BY THESE TERMS.
1. About the Marketplace
- Platform Role: RentalFlexi acts strictly as an online peer-to-peer marketplace matching private vehicle owners ("Hosts") with drivers seeking transportation ("Guests").
- No Vehicle Ownership: RentalFlexi does not own, operate, manage, buy, sell, or rent any vehicles listed on the platform.
- Independent Contracting: RentalFlexi is not a traditional car rental company or an insurer. All contractual agreements regarding vehicle usage exist directly between the Host and the Guest.
2. Eligibility & Verification
To register an account on rentalflexi.co.za, users must satisfy distinct criteria:
- Age Limit: Guests must be at least 18 years old (or 21/23 for specific high-tier vehicle classifications as designated by the platform).
- Licensing: Guests must possess a valid, unendorsed South African driver’s licence or an official International Driving Permit (IDP) accompanied by their native home country licence.
- Identity Verification: Users must supply a valid SA Identity Document (ID), a verified e-mail address, and an SMS-enabled South African mobile phone number.
- POPIA Compliance: By creating an account, you explicitly authorise RentalFlexi to process your personal information and conduct background checks, including driver’s licence validation and credit assessments in compliance with the Protection of Personal Information Act (POPIA).
3. Host Obligations & Maintenance
Hosts who list their vehicles on rentalflexi.co.za commit to strict quality and compliance metrics:

- Roadworthiness: Hosts warrant that any vehicle listed is legally registered, possesses a current license disc, and is strictly in a safe, roadworthy, and mechanically sound condition.
- Legal Disclosures: Vehicles must have a clean title and must not be subject to any active safety recalls or mechanical hazards.
- Pre-Trip Verifications: Hosts must verify that the individual picking up the vehicle matches the registered, Approved Driver profile on the RentalFlexi app or website.
4. Guest Obligations & Prohibited Uses
Guests bear full responsibility for the vehicle throughout the duration of the booked trip.

- Approved Drivers: Only the specific user who reserved the vehicle, alongside any secondary drivers explicitly registered and approved by RentalFlexi for that trip, may operate the vehicle.
- Prohibited Activities: The following actions constitute a direct, severe material breach of these terms:
- Operating the vehicle under the influence of alcohol, narcotics, or restricted medications.
- Using the vehicle for commercial ride-sharing or e-hailing delivery services (e.g., Uber, Bolt, Mr D) unless explicitly authorised under a commercial listing plan.
- Driving off-road or navigating undeveloped, unpaved terrain not designed for normal passenger cars.
- Smoking, vaping, or transporting unauthorized pets inside the vehicle.
- Transporting illegal, hazardous, toxic, or volatile goods.
- Participating in racing, speed testing, or track-day competitions.
- Towing or pushing other vehicles or trailers without prior written consent from the Host and RentalFlexi.
- Transporting the vehicle across international land borders outside the Republic of South Africa without explicit cross-border documentation issued by the Host and the platform.
5. Fees, Fuel, and Traffic Infringements

- Platform Fees: RentalFlexi charges booking fees to Guests and commission or listing fees to Hosts. These rates are fully broken down at the checkout interface.
- Fuel Policy: The Guest must return the vehicle with the exact same level of fuel it possessed at the start of the trip. Failure to do so will result in refueling charges plus a platform administrative fee.
- Traffic Fines: The Guest is fully liable for all traffic, speeding, toll (including e-tolls), and parking infringements incurred during the booking window. RentalFlexi reserves the right to automatically charge these balances to the Guest's payment method, along with a processing fee.
- Overtime Return: A 30-minute grace period applies to returns. Exceeding this window without an approved digital trip extension will trigger automated hourly or daily late fee penalties.
6. Protection Plans and Insurance
- Contractual Allocation: RentalFlexi does not offers various contractual protection plans, we urge all guest to liaise with the host in finding out which insurance plans are available.
- The Excess: Depending on the tier chosen insurance, the Guest will be liable for a designated damage excess amount charged per insurance. Query with the host regarding the access amount payable on such events
7. Cancellations and Refunds
In alignment with the South African Consumer Protection Act (CPA):
- Free Cancellation: Guests may cancel a reservation and receive a 100% refund up to 24 hours prior to the scheduled trip start time.
- Late Cancellations: Cancellations made within less than 24 hours of the trip start will incur a cancellation penalty equivalent to a single day’s rental fee plus applicable booking costs.
- No refund will be given after 24hrs of trip scheduled start time
- Host Cancellations: If a Host cancels a reservation unexpectedly, the Guest will receive a full refund, and the Host will face platform penalties, potential search demotions, or account suspension.
